Rogue architect handed £7,500 fine for title misuse

Malcolm Capstick of Smart Design Group has been fined £7,500 for falsely claiming to be an architect

On 26 November at North and East Devon Magistrates’ Court Capstick pleaded guilty to using the title ‘architect’ on advertising material on three separate ocassions when he was not legally entitled to do so.  

Capstick assured the ARB he would cease using the title but continued to use the term on his website and on promotional material distributed at a trade show – according to an ARB statement.

Despite ARB requests, Capstick failed to provide ‘any real assurance’ he would refrain from using the promotional material in the future, and failed to amend the Smart Design Group website.

In defence, Capstick said his intention was to go into business with a chartered architect but he failed to name any individual prior to the hearing date. 

He also said his website designer, who attended the hearing, had failed to make the requested amendments to the site in question.

After considering mitigation, the court awarded the total sum of £7,872.24 against Capstick.
